Student Arrested For Writing Zombie Story

] Winchester police say William Poole, 18, was taken into
] custody Tuesday morning. Investigators say they
] discovered materials at Poole's home that outline
] possible acts of violence aimed at students, teachers,
] and police.

] Poole told LEX 18 that the whole incident is a big
] misunderstanding. He claims that what his grandparents
] found in his journal and turned into police was a short
] story he wrote for English class.

] "My story is based on fiction," said Poole, who faces a
] second-degree felony terrorist threatening charge. "It's
] a fake story. I made it up. I've been working on one of
] my short stories, (and) the short story they found was
] about zombies. Yes, it did say a high school. It was
] about a high school over ran by zombies."

] Even so, police say the nature of the story makes it a
] felony. "Anytime you make any threat or possess matter
] involving a school or function it's a felony in the state
] of Kentucky," said Winchester Police detective Steven
] Caudill.

] "It didn't mention nobody who lives in Clark County,
] didn't mention (George Rogers Clark High School), didn't
] mention no principal or cops, nothing,"

] On Thursday, a judge raised Poole's bond from one to five
] thousand dollars after prosecutors requested it, citing
] the seriousness of the charge.

The Orwellian thought police are on the way.

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.

There is an obvious comment to make about this jackass but I've been advised not to taunt happy fun ball.

[ This story is a little too lacking to make any kind of actual assessment. I'd have to read the journal outtake, I guess, and see if there was any context to support the fact that it was part of a zombie story. Still, by default, I tend side with the kid, as I think, in general, police and school administrators aren't the most tolerant of anything that seems subversive or angry at all. Perhaps I'm being unfair, but, *shrug*. -k]

It might not be, but when you arrest someone for writing things there is a very high bar that you need to reach for credibility. It is not legal to arrest someone for thought crime or for the contents of their private journal. Quotations like "Anytime you make any threat or possess matter involving a school or function it's a felony in the state of Kentucky" don't generate a lot of confidence. A private journal is not a threat. In order to threaten someone you have to actually present the threat to them. And it certainly is not a "felony in the state of kentucky" to posses "matter" involving a "school or function," whatever the hell that means. Was he or was he not actually planning an attack? Who knows. Until there is some shred of information which indicates that he might have, one must assume that he was not, and as being arrested for one's writings is a very grave matter one must express some concern with the situation.
