Free Judy Miller

The New York Times reporter Judith Miller has now been in jail longer for refusing to testify than any reporter working for a newspaper in America. It is a very long time for her, for her newspaper and for the media. And with each dismal milestone, it becomes more apparent that having her in jail is an embarrassment to a country that is supposed to be revered around the world for its freedoms, especially its First Amendment that provides freedom of the press. Ms. Miller, who went to jail rather than testify in an investigation into the disclosure of an undercover agent's identity, has been in a Virginia jail 55 days as of today.

... or 56 days at the time of this posting.

Integrity comes at a price. Its very upsetting that for this reporter, that price is her freedom.

Its time to start printing up those yellow stickers that say "FREE JUDY".

It is time not to. When you have a reporter who is protecting a whistleblower from reprisal, that is a case where the source needs to be (and should be) protected. What appears to be the case here is that Judy Miller is protecting someone who may have committed a felony in trying to strike back at a whistleblower (who was right).

Judy Miller is currently in jail on civil contempt charges. Her next option is criminal contempt for protecting someone who was going out of their way to harm someone else. This is something that is not protected and should have the same level of protection as a psychiatrist told by a patient that the patient plans to kill someone. It is incumbent on them to inform the authorities so that protective measures can be taken, and if that is not done, they are both civilly and criminaly liable.

This was about scoring points, not anything that was actually "news" and she should talk to the Grand Jury.

A second little note on this, a great deal of information about who said what in this investigation has been leaked to the press. Grand jury investigations are "closed" and the people who we have been getting the reports about are the people who are suspected to be the people being investigated. Pat Fitzgerald isn't releasing this stuff, so who is? The lawyers for people like Rove and Libby who are using the leaks to spin the information so their clients look better before the indictments start coming down.
